BLM Eyes 90,000 Acres of Texas Land

After the recent Bundy Ranch episode by the U.S. Bureau of Land Management (BLM), Texans are becoming more concerned about the BLM’s focus on 90,000 acres along a 116 mile stretch of the Texas/Oklahoma boundary. The BLM is reviewing the possible federal takeover and ownership of privately-held lands which have been deeded property for generations of Texas landowners.
Sid Miller, former Texas State Representative and Republican candidate for Texas Agriculture Commissioner, has since made the matter a campaign issue to Breitbart Texas.

“In Texas,” Miller says, “the BLM is attempting a repeat of an action taken over 30 years ago along the Red River when Tommy Henderson lost a federal lawsuit. The Bureau of Land Management took 140 acres of his property and didn’t pay him one cent.”

Miller referred to a 1986 case where the BLM attempted to seize some of Henderson’s land. Henderson sued the BLM and lost 140 acres that had been in his family for generations. Now the BLM is looking at using the prior case as a precedent to claim an additional 90,000 acres.

Congressman Mac Thornberry (R-TX) represents the ranchers in this region of north Texas. According to Thornberry’s legislative analysts, the issue of the ownership of this land dates back to the Louisiana Purchase of 1803. When the BLM made the claim on Henderson’s land, their position was that Texas never had the authority to deed the land to private parties and therefore it would fall under federal control.

In 1922, the U.S. Supreme Court attempted to settle the boundary dispute in Oklahoma v. Texas and declared the boundary to be defined by wooden stakes set on the river bank. That boundary apparently lasted no longer than anyone could expect wooden stakes to last in the shifting sands of a meandering river. In 2000, Texas and Oklahoma’s legislatures agreed to a “Red River Boundary Compact” which defined the border between the states as the southern vegetation line. However, Congress must ratify agreements of this kind between the states according to Article 1, Section 10 (Clause 3) of the U.S. Constitution. Congressman Thornberry introduced House Joint Resolution 72 during the 106th Congress to codify the compact into U.S. Law.

The matter became somewhat of a national question drawing the attention of Vermont Senator Bernie Sanders, “The U.S. Supreme Court has tried twice to settle this dispute, which at one point brought the governor of Oklahoma to the border in a tank…However, true to the slogan ‘One Riot, One Ranger,’ the good governor of Oklahoma and his tank was held off by a lone Texas Ranger on his horse.”

Nevada Senator, Governor Join Critics of Bundy Ranch Roundup

Wednesday, Sen. Dean Heller (R-NV) joined Nevada Governor Brian Sandoval in criticizing the federal government’s handling of the Bundy cattle dispute, arguing that the U.S. Bureau of Land Management  was “overreaching” while Sandoval blasted the department for creating “an atmosphere of intimidation” by the extreme manner in which it was seizing Bundy’s private property.

Federal agencies now manage or control more than 80 percent of Nevada, which has led to numerous disputes with ranchers who have challenged federal land ownership. For over 20 years, Rancher Cliven Bundy has been disputing grazing rights with state and federal agencies over 250 square miles of federal reserve land in a remote Nevadan location 80 miles northeast of Las Vegas.

Bundy and his family had been using the area as grazing land for decades, when in 1993 federal land managers expressed concern for federally-protected tortoises, capping Bundy’s herd number at 150. Eventually, federal officials revoked Bundy’s grazing rights altogether. However, Bundy has ignored land managers’ restrictions, claiming preemptive grazing rights and refusing to remove them and pay what the agency claims is $1.1 million in unpaid grazing fees.

The dispute finally came to a head when the BLM ordered the confiscation of Bundy’s cattle, which has involved moving in a reported 200 armed agents, bringing in hired ranchers to roundup the cattle, and shutting down a 1,200 square-mile area through May 12. After an argument over protestors’ rights to film the cattle being confiscated, federal agents also marked off a “First Amendment Area” beyond which they said no protestors could operate without potential consequences. The federal agency’s action, particularly the “First Amendment Zone,” forced the Nevada Republican governor into the fray Tuesday, who made a formal statement blasting the BLMfor “trampl[ing] upon Nevadans fundamental rights”:

Due to the roundup by the BLM, my office has received numerous complaints of BLM misconduct, road closures and other disturbances. I have recently met with state legislators, county officials and concerned citizens to listen to their concerns. I have expressed those concerns directly to the BLM.

Most disturbing to me is the BLM’s establishment of a “First Amendment Area” that tramples upon Nevadans’ fundamental rights under the U.S. Constitution. To that end, I have advised the BLM that such conduct is offensive to me and countless others and that the “First Amendment Area” should be dismantled immediately. No cow justifies the atmosphere of intimidation which currently exists nor the limitation of constitutional rights that are sacred to all Nevadans. The BLM needs to reconsider its approach to this matter and act accordingly.

Wednesday, Senator Heller weighed in on the issue, stating that after hearing from locals and the Nevada Cattlemen’s Association about the massive land closure—which covers an area half the size of Delaware—he had become “extremely concerned about the size of this closure and disruptions with access to roads, water and electrical infrastructure.” Heller told the new BLM chief, Neil Kornze (former advisor to Harry Reid), that the “overreaching” agency was penalizing law-abiding Nevadans.

Meanwhile, Rep. Steven Horsford (D-Las Vegas) defended the BLM’s actions, arguing that the agency was simply enforcing court orders to remove the animals from federal land.

BLM and Park Services deem their drastic tactics necessary due to the threatening nature of some of Bundy’s comments. At one point Bundy called the dispute a “range war” and promised to “do whatever it takes” to protect his private property.

Federal agents have seized more than 200 of Bundy’s 900 cattle so far.

Obama ‘Champion Of Change’ Amnesty Advocate Indicted For Immigration Fraud

An amnesty advocate that President Barack Obama’s White House publicly promoted as part of its “Champion of Change” series has been indicted in federal court on charges of fraud.

Bonnie M. Youn, who Obama’s White House touts on its website as “a recognized Asian American & Pacific Islander (AAPI) community leader in Georgia,” was indicted on three criminal charge counts in the U.S. District Court for the Northern District of Georgia Atlanta Division on April 1, according to publicly filed court documents.

The first indictment count alleges Youn committed perjury with regard to an alien illegally in the United States. The second indictment count alleges that Youn violated a federal immigration law that prohibits bringing illegal aliens into the United States and harboring them, alleging she did so “for the purpose of commercial advantage and private financial gain.” The third indictment count alleges Youn illegally tampered with witness testimony, specifically alleging she influenced the illegal alien—whose identity is kept anonymous in the indictment—to provide false information about employment in the United States to federal agents.

The indictment, signed by U.S. Attorney Sally Quillian Yates and two Assistant U.S. Attorneys, indicates that Youn’s alleged illegal activity began “on or about February 9, 2009,” just as President Obama took office at the beginning of his first term and before she was honored by the White House. The third indictment count says that the alleged witness tampering began on or about August 15, 2011.

An arrest warrant was filed for Youn Tuesday.

Youn is listed on the White House “Champions of Change: Immigration Reform” website. That site, which along with a page specifically about her remains on WhiteHouse.gov after she was indicted on these criminal charges related to the White House’s honoring of her, states she was awarded the title for being like Cesar Chavez. “The White House honors eleven people who embody the spirit of Cesar Chavez’s legacy and commit themselves to working in their communities to advocate and organize around immigration-related issues,” the White House says on the website that features Youn.
